Swerving to Avoid a Crash

Swerving to Avoid a Crash

Swerving to Avoid a CrashSwerving to avoid a crash is a natural instinct for most drivers but is it always safe to swerve? Idaho State Police reported a crash involving two pickup trucks on Highway 75. A Chevy Silverado traveling northbound on State Highway 75 crossed over the center line into the southbound lane. An oncoming Ford F350 swerved to avoid being hit by the Chevy and ended up driving into a bar ditch. The Chevy struck the Ford F350 in the southbound lane. All occupants were reportedly wearing seatbelts at the time of the crash. Traffic was blocked for about three hours as crews worked to clear the accident.

Swerving to Avoid a Crash

To avoid injury in a car accident, it is a natural instinct to want to swerve. If a driver is distracted and comes into your lane, you might be able to avoid a crash without injury by driving onto the shoulder of the road, honking your horn to alert the other driver, or swerving around the potential car accident. However, some experts would say you should never swerve. Here’s why.

Insurance

From an insurance perspective, if the other car causes a car accident a claim can easily be made against their insurance. No questions asked. It is easy to determine fault. However, if you swerve and end up running into another vehicle or fixed object along the road side, the distracted driver may just drive off because they were not involved in a crash.  They are not required to stop; therefore, you will not be able to gather their information or insurance. It’s a lot harder to pin the crash on the driver who was really at fault.

Surroundings

Another reason not to swerve is the surroundings around you could be more dangerous. You might swerve into a pedestrian or hit an object that cause your vehicle to roll increasing your risk of injury. You may also end up causing a far worse accident. For example, if a car cuts you off and you suddenly swerve into another lane and crash with a different car, then you caused the accident. You could also swerve right into oncoming traffic and be hit head-on.

Injury Crash on Yellowstone Highway from Driver Failing to Yield

Injury Crash on Yellowstone Highway from Driver Failing to Yield

Injury Crash on Yellowstone Highway from Driver Failing to YieldIdaho State Police reported an injury crash on Yellowstone Highway from a driver failing to yield. A vehicle traveling eastbound on 65th S attempted to turn left onto Yellowstone Highway to go northbound and collided with an oncoming pickup truck. Police reported both drivers were transported by private vehicles to a nearby medical center for evaluation of injuries. The southbound lanes of Yellowstone Highway were partially blocked for a little over an hour as crews worked to clear the car accident.

Consequences of Failing to Yield

A common cause of car accident is failing to yield. Many impatient drivers cause a collision with just a quick misjudgment. However, all drivers have a duty to obey all rules of the road in order to avoid causing a collision. See Idaho Rules of the Road regarding failure to yield here.

Failure to yield the right of way when required by law can lead to liability for any resulting car crash. The difference between these types of accidents and other car accidents is that often the injury victim drives into the car that fails to yield. For instance, when a driver makes a left turn but fails to yield to oncoming traffic, or when a driver is aggressive about merging onto the highway, or when a driver is entering the street from a private driveway.

Failing to Yield is Negligent Driving

When a person is hurt by another driver failing to yield, the at-fault or negligent driver can be sued for damages. Things such as medical bills, damage to the vehicle, pain and suffering and more can all be compensated for during a car accident case.

After an accident, take photos of all property damage to your vehicle and all other vehicles involved. It is also a good idea to keep records and take photos of injuries. You should also exchange contact and insurance information with all other drivers. In addition, gather contact information of any witnesses to the accident. Providing all this information and evidence to your car accident lawyer can greatly help the outcome of your case.

Two Injured from Car Crash in Pocatello

Two Injured from Car Crash in Pocatello

Two Injured in Car Crash from Driver Running a Red LightIdaho State Police reported two injured in a car crash from a driver running a red light in Pocatello. The crash occurred when a driver failed to stop at a red light, entering the intersection at a high rate of speed. A passenger vehicle was struck in the intersection. After impact, the vehicle continued and struck a nearby building. Both drivers involved in the car crash were reportedly injured. Only one was wearing a seatbelt at the time of the collision. Both were transported by ground ambulance to a nearby medical center for evaluation of injuries. Idaho State Police is investigating this car crash.

Why Do Drivers Run Red Lights?

56 percent of drivers admit to running red lights part of the time. That’s a large percentage. But why? Most of the time, drivers run a light when it has just barely turned red. For instance, if the driver in front took a bit longer than expected to proceed through the intersection or the driver thinks they can “beat the yellow” and misjudge the timing.

The vast majority of drivers run red lights because they are in a hurry or they are feeling impatient. However, is the risk of a car accident worth arriving two or three minutes later? No. Of course not. Running a red light creates tremendous danger for the driver, passengers, and any other drivers on the road. Even when the driver has an arguably good reason to run a red light, such as an emergency situation, it’s important to avoid the temptation.

Consequences of Running a Red Light

A driver has a split-second to decide if they are going to proceed after the light turns yellow. That leaves little time for the driver to consider the possible life-altering consequences of running a red light. The following are a few consequences of running a red light.

Car Accident Fatalities from Running a Red Light

About 60 people were killed each month in a car accident during 2015 as a result of a driver deciding to run a red light. That amounts to over 800 fatalities per year or about two fatal car accidents each day in America from a driver running a red light.

Significant Injuries from Running a Red Light

An accident from someone running a red light typically involves the vehicle moving at a high rate of speed. Red light running accidents usually result in a “t-bone” collision that often results in serious injuries or even death. Due to the lack of protection on the sides of a vehicle, an angular collision such as a “t-bone” accident often leads to serious injuries.

Aggressive Driving

Running a red light is known as aggressive driving. Aggressive driving reflects a driver’s lack of care or safety to other drivers. These types of actions often lead to severe sanctions or even criminal penalties if an accident occurs.

How to Avoid Red Light Accidents

There is no guarantee of avoiding a collision with someone running a red light. However, there are a few things you can do to decrease the odds.

Pause Before Proceeding

Before proceeding through the intersection, count to three. Pausing to wait before you move through the intersection after the light turns green could save you from a collision.

Look Before Proceeding

Before proceeding through the intersection after the light has turned green, look both ways as if you would before crossing the street.

Pay Attention to Those Around You

Many drivers become distracted with their cell phone while waiting at a stop light. Avoid temptation. Instead, pay attention to the flow of traffic. Are other drivers around you acting erratically? Is traffic heavy? What might the person next to you be thinking of doing after the light turns green? Will they cut you off to get ahead of some traffic? All of these questions are things to consider to help you avoid a collision.

Missing Your Exit vs. Causing a Car Accident – Reckless Driving

Missing Your Exit vs. Causing a Car Accident – Reckless Driving

Missing Your Exit vs. Causing a Car Accident – Reckless DrivingWhile driving down the highway you may see a vehicle quickly cross over several lanes in order to make their exit. But how much of a risk for a car accident does this type of maneuver pose? Idaho State Police reported a driver traveling northbound on I-15 near Idaho Falls driving in the left lane when they quickly crossed over all lanes to make the exit. However, instead of exiting the highway they caused a car accident with a vehicle that was traveling in the right lane. Both vehicles went through the guardrail on the right side of the roadway and down the embankment. One vehicle rolled and came to rest on its top. Both drivers were wearing seatbelts at the time of the car accident. The exit ramp was blocked for about three hours as crews investigated and cleared the accident.

Missing Your Exit vs. Causing a Car Accident – Reckless Driving

Crossing over all lanes of traffic in order to make an exit is reckless driving. The National Highway Traffic Safety Administration (NTHSA) defines reckless or aggressive driving as occurring when “an individual commits a combination of moving traffic offenses so as to endanger other persons or property.” From 2003 to 2007, aggressive or reckless driving played a role in 56 percent of fatal car accidents with speed playing the number one factor. These statistics are from data collected by NHTSA’s Fatal Accident Report System (FARS).

Car Accident Statistics Due to Reckless Driving

More than 90 percent of car accidents are caused by human error including reckless driving. Many believe if we could change the manners and mentality of drivers, there would be a significant reduction in reckless driving accidents. The following are some statistics to support such an argument.

  • 33 percent of all major fatal car accident is caused by reckless driving. That is more than 13,000 per year.
  • 30 percent of car accidents are caused by speeding.
  • Distracted driving causes about 20 percent of car accident injuries.
  • 40 percent of fatal car accidents are attributed to driving under the influence.

In all of these statistics, human error is to blame for all these accidents whether a driver chose to drive under the influence, speed, or drive distracted.

How to Prevent Reckless Driving Accidents

Car accidents are preventable if drivers observe all traffic and safety laws. However, when a negligent or irresponsible driver causes a major accident, an experienced car crash lawyer can help to compensate damages such as medical expenses, lost wages, and future financial income that may have been lost as a result of the accident.

The following are some ideas of how to prevent reckless driving accidents.

  • Be aware of other drivers around you and have an escape route in case of an emergency.
  • Always pay attention to the road when driving.
  • Never drive distracted.
  • Remember to always wear a seatbelt.
  • Stay clear of dangerous drivers by noticing their maneuvers ahead of time.
  • Report suspicious behavior of other drivers on the road to prevent a possible accident.

What Happens Following the Wrongful Death of a Passenger?

What Happens Following the Wrongful Death of a Passenger?

What Happens Following the Wrongful Death of a Passenger? In most car accident or wrongful death claims, the suit is towards the driver of the other vehicle. However, when a passenger is injured or dies from the negligence of the driver of the car in which the passenger was riding, a case can be made against the driver. In the car accident mentioned above, the passenger was not at fault for the negligence of the driver. Surviving family members can then bring forth what is known as a wrongful death case.

Wrongful Death Case Scenarios

The following are some scenarios in which filing a wrongful death case would be applicable.

Car Accident

Many wrongful death cases are filed after a fatal car accident. There are many ways the other driver can be found negligent for the victim’s death following a car accident. For instance, a distracted driver who caused a car crash can be held responsible for their negligent behavior through a wrongful death case if they killed the other driver. Anyone operating a motor vehicle is under oath to act responsibly and drive safely. When a negligent driver chose to do otherwise and harms another, they should be held accountable.

DUI

A driver under the influence of drugs or alcohol is a prime candidate for being held responsible for a fatality. Clearly, it is easy to see the negligence of a drunk driver.

Premises Liability

Incidents such as a slip and fall accident where the owner of the property should have known of the hazardous circumstances that caused a death make the owner liable for negligence. It is rare for a person to die from a slip and fall accident or other common premise liability scenarios. However, situations such as an accidental drowning, also fall under this category.

Legal Definition of Wrongful Death

Wrongful death is a legal term to describe a claim that certain individuals can make against a person who wrongfully or negligently causes the death of another. Wrongful death claims are enacted by the state legislature to govern who can bring a wrongful death claim.

A wrongful death lawsuit allows the victim’s family to seek out compensation any financial losses acquired as a result of the death. Wrongful death is also a way the family can seek justice against the negligent party.
