5 Steps to Take After a Slip and Fall Accident

5 Steps to Take After a Slip and Fall Accident

5 Steps to Take After a Slip and Fall AccidentSlip and fall accidents are all too common. However, not all slip and fall accidents will result in a good cash settlement. Most slip and fall accidents happen because of wet, dirty or defective floors. In addition, most accidents happen in a grocery store, parking lot, or in a mall. Ultimately, each person is responsible for their own safety and the safety of any small children accompanying them. If you find yourself the victim of a slip and fall accident, here are five steps to take after a slip and fall accident.

1. Document the Accident Scene

After a slip and fall accident in a store, employees arrive with mops, wet floor signs, and even cameras. The accident scene can change very quickly. If you are able, take pictures of the scene with your cellphone and immediately write down your own statement of what happened. In addition, get names, addresses and phone numbers of any non-employee witnesses. All evidence will be gone once you leave the store.

2. Report Your Accident Immediately

Immediately following a slip and fall accident you need to report it to store personnel and make an accident report. Even if you are not seriously injured, failing to report the accident can ruin your case. Employees who come to assist you after a slip and fall accident are there to gather evidence to help the store avoid paying you. They are not likely there to help you.

3. Seek Medical Treatment

If you have been injured in a slip and fall accident, you must seek medical treatment so your injuries can be properly documented. It is important to seek treatment immediately. If you wait, the insurance company or store personnel where you fell, can make a claim that you injured yourself at a later time. If your injuries are severe, visit the ER or urgent care. If your injuries are not serious, see your family doctor as soon as possible. The store’s insurance adjusters will question all medical treatment you receive, especially if you have pre-existing injuries.

4. You May Not Always Recover a Cash Settlement

Many believe if they are injured in a store, they automatically have a good claim and will be able to recover a cash settlement. That is not true. If you have sustained considerable damages or injuries from a fall, you must still be able to prove what caused you to fall before you can receive compensation. Just because a business owns the property, they are not automatically liable for your injuries if you fall on their property. Other circumstances will be taken into account when determining liability.

5. Speak with an Experienced Slip and Fall Accident Lawyer

Before speaking with your insurance company, talk with an experienced slip and fall accident lawyer from Brent Gordon Law Firm. Insurance adjusters will tape record an interview you to try to hurt your case and offer you a lower settlement. Everything you say can be used against you or hurt your case. Make sure to talk to an experienced slip and fall lawyer before you talk to the adjusters. The slip and fall accident lawyers at Brent Gordon Law Firm will fight for every penny you are owed. When you call us, you will be able to discuss your accident with an experienced and trusted lawyer for free. In fact, you’ll pay nothing until we settle your case. Recoverable Compensation After an Accident

Recoverable Compensation After an Accident

What to do Before Speaking to a Personal Injury AttorneyAfter being injured in a car accident, motorcycle accident, semi truck accident or any other type of injury accident, the insurance company will press to come to a quick settlement. This is so you get as little compensation for damages as possible. The insurance company wants to save themselves money. Many clients don’t even understand what damages they may be able to recover for. This is just one reason why it is important to hire an experienced attorney from Brent Gordon Law Firm to handle your case. Our trusted and knowledgeable personal injury attorneys will fight for every penny you are owed. The following is a list of some damages that may be recoverable after your personal injury accident.

Recoverable Compensation After an Accident

Expenses from Medical Treatment

All expenses that were incurred during treatment are considered medical expenses. Emergency room, hospital costs, doctor visits, chiropractic care fees, physical therapy and/or rehabilitation are all bills that you should be compensated for. Your attorney will help you deal with the insurance companies and medical bills.

Future Medical Expenses

If you’ve been injured so severe that you will need on-going medical care as a result of an accident, your future medical expenses are also recoverable damages. The amount recoverable will be determined based on the advice of your doctors and other medical professionals.

Pain and Suffering

Physical pain resulting from an accident is also recoverable damage. Based on the nature of the injury, the severity of the pain, and by how long the pain lasts your recoverable damage will be determined.

Lost Wages

Sometimes after an accident, the injuries incurred keep a person from being able to work. You may recover lost income that you would have earn had you not been injured in an accident. Typically, the awarded amount includes the wages you would have been making between the time of the accident and the time of settlement or judgment. If you are unemployed but can prove you would have been earning income, you may also recover lost wages. In addition, if you can show that your ability to earn a living was impaired by the accident or injury for future earning capacity, that may also be recoverable.

Consortium Loss

When a spouse is injured in accident damage such as loss of companionship, affection, comfort, solace, help and sexual relations may also be recoverable. These damages refer to the loss of the benefits of married life.

Emotional or Mental Distress

Sometimes a person will suffer emotional or mental distress after an accident or injury. Feelings of apprehension, anxiety, fright, nervousness, loss of dignity, worry, humiliation, shock, grief, or embarrassment are all considered mental anguish and can be considered recoverable damages. In addition, if you suffered permanent disfigurement from the accident, you may also be able to recover for mental suffering.

Property Damage

Obvious recoverable damage from the accident is property damage for your car or any other property that was damaged.

Missing Your Exit vs. Causing a Car Accident – Reckless Driving

Missing Your Exit vs. Causing a Car Accident – Reckless Driving

Missing Your Exit vs. Causing a Car Accident – Reckless DrivingWhile driving down the highway you may see a vehicle quickly cross over several lanes in order to make their exit. But how much of a risk for a car accident does this type of maneuver pose? Idaho State Police reported a driver traveling northbound on I-15 near Idaho Falls driving in the left lane when they quickly crossed over all lanes to make the exit. However, instead of exiting the highway they caused a car accident with a vehicle that was traveling in the right lane. Both vehicles went through the guardrail on the right side of the roadway and down the embankment. One vehicle rolled and came to rest on its top. Both drivers were wearing seatbelts at the time of the car accident. The exit ramp was blocked for about three hours as crews investigated and cleared the accident.

Missing Your Exit vs. Causing a Car Accident – Reckless Driving

Crossing over all lanes of traffic in order to make an exit is reckless driving. The National Highway Traffic Safety Administration (NTHSA) defines reckless or aggressive driving as occurring when “an individual commits a combination of moving traffic offenses so as to endanger other persons or property.” From 2003 to 2007, aggressive or reckless driving played a role in 56 percent of fatal car accidents with speed playing the number one factor. These statistics are from data collected by NHTSA’s Fatal Accident Report System (FARS).

Car Accident Statistics Due to Reckless Driving

More than 90 percent of car accidents are caused by human error including reckless driving. Many believe if we could change the manners and mentality of drivers, there would be a significant reduction in reckless driving accidents. The following are some statistics to support such an argument.

  • 33 percent of all major fatal car accident is caused by reckless driving. That is more than 13,000 per year.
  • 30 percent of car accidents are caused by speeding.
  • Distracted driving causes about 20 percent of car accident injuries.
  • 40 percent of fatal car accidents are attributed to driving under the influence.

In all of these statistics, human error is to blame for all these accidents whether a driver chose to drive under the influence, speed, or drive distracted.

How to Prevent Reckless Driving Accidents

Car accidents are preventable if drivers observe all traffic and safety laws. However, when a negligent or irresponsible driver causes a major accident, an experienced car crash lawyer can help to compensate damages such as medical expenses, lost wages, and future financial income that may have been lost as a result of the accident.

The following are some ideas of how to prevent reckless driving accidents.

  • Be aware of other drivers around you and have an escape route in case of an emergency.
  • Always pay attention to the road when driving.
  • Never drive distracted.
  • Remember to always wear a seatbelt.
  • Stay clear of dangerous drivers by noticing their maneuvers ahead of time.
  • Report suspicious behavior of other drivers on the road to prevent a possible accident.

Semi Truck Overturns on Northbound I-15 Causing Injury

Semi Truck Overturns on Northbound I-15 Causing Injury

Semi Truck Overturns on Northbound I-15 Causing InjuryA semi truck overturned on northbound I-15 causing injury to the semi truck driver. Idaho State Police reported a sing-vehicle injury crash south of Malad when a semi truck hauling a single trailer drove off the left shoulder causing the semi to overturn. The driver of the semi truck was taken by ground ambulance to a nearby hospital for evaluation of injuries. Police reported the left lane of traffic blocked for about six hours as crews worked to clear the wreckage. The following are some tips to avoid an accident when debris is on the roadway following a semi truck overturned.

Tips to Avoid an Accident from Road Debris

The following are a few tips to help you avoid a car crash with road debris.

  1. Scan the road ahead continually to search for any road debris or hazards.
  2. Always have a plan to escape in the event there should suddenly appear debris in your lane. Know where other cars around you. Maintain an open space in front and at least one side of your vehicle at all times. Should a need arise, you could steer into that open space to avoid a collision with an object on the road.
  3. Never tailgate! Leave a safe traveling distance between you and the car in front of you at all times. A good suggested amount of time is three to four seconds. More if the roadway is in bad condition.
  4. When driving at night or at dusk, be especially alert for animals or debris on the roadway.
  5. If you are about to hit debris, safely slow down as much as possible prior to making contact and try to hit it with a tire.

Road Debris Car Crash Statistics

Debris-related car crashes are often preventable. In fact, according to the AAA Foundation for Traffic Safety, two in three car crashes caused by debris result from items falling from a vehicle due to unsecured cargo or improper maintenance. Common road debris includes things that detach from a vehicle or unsecured cargo such as furniture. Other common road debris could also include a tow trailer becoming separated from pulling vehicle.

Though every state has laws making it illegal for items to fall from a vehicle, fines can range from just $10 up to $5,000. In addition, 16 states list jail as a possible punishment for offenders of lost cargo.

Injury Semi-Truck Accident on State Highway 33

Injury Semi-Truck Accident on State Highway 33

Injury Semi-Truck Accident on State Highway 33Idaho State Police reported an injury semi-truck accident on State Highway 33 in Driggs, Idaho. A passenger vehicle was driving northbound on SH33 when the driver crossed over the center line and into a semi-truck driving southbound. The driver of the passenger vehicle was transported by ground ambulance to a nearby hospital for evaluation of injuries. It was also reported that she was not wearing a seatbelt at the time of the semi-truck accident. The driver of the semi-truck was uninjured and did not need to be transported. It was reported that the highway was blocked for about three and a half hours will crews worked to clear the accident.

Injury Semi-Truck Accident Statistics

When a semi-truck accident occurs, it is more likely to result in death or serious injury than an accident between two small vehicles. The accident is far more dangerous for the driver in the car than it is for the driver in the truck. In fact, according to the National Institute of Traffic and Highway Safety, 73 percent of all truck crash injuries and deaths are suffered by the driver in the car.

The following are more nationwide injury semi-truck accident statistics from the National Highway Traffic Safety Administration.

  • Injuries from a semi-truck accident account for eight percent of all fatal crashes and three percent of all automobile injuries in the U.S.
  • 63 percent of tractor trailer accidents occur on rural roads.
  • Only five percent of semi-truck accident was due to a semi-truck rolling over.
  • 83 percent of semi-truck accidents happen on weekdays.
  • Only one percent of truck accident injuries are fatal.
  • 23 percent of truck accidents result in injury.

Tips to Prevent a Head-on Truck Accident

  • On multiple-lane highways, drive in the right-hand lane. This will make it safer and easier to pull over into a ditch or off the side of the road rather than hitting head-on.
  • If you see an oncoming vehicle heading straight for you, quickly veer to the right. This will prevent you from going into lanes of other vehicles.
  • Gain more stability by keeping the two wheels on the driver’s side on the pavement when pulling over to a shoulder.
  • Choose to hit a fixed object on the side of the road rather than hitting another vehicle. The fixed object has no momentum and will usually cause less injury.
  • If you come across an aggressive driver, don’t react to them in the same manner. Let them pass.
  • Semi-trucks require more time to react. Avoid making unpredictable actions such as quick lane changes.
  • Avoid driving in a semi-truck driver’s blind spot. Always make sure you can see a truck driver in their side mirror. This guarantee’s that they can see you.
