Idaho State Police reported an injury crash in Idaho Falls caused by a driver failing to yield the right of way at a stop sign. The car accident occurred when a pickup truck proceeded through the intersection after stopping at a stop sign. The truck was struck by a car which failed to yield at the stop sign. After the car struck the pickup truck it then collided head-on with a power pole. Both drivers were transported by ground ambulance to a nearby hospital for evaluation of injuries. Traffic was blocked for about two hours while crews worked to clear the crash and police investigated.
Failing to Yield at a Stop Sign
The law states a vehicle approaching an intersection should yield the right of way to any vehicle or person that has entered the intersection from a different roadway. A driver does not need to wait until the intersection is completely clear. However, the law prohibits deliberate crowding or interfering with another vehicle already in the intersection.
At a four-way stop or intersection without lights or signs is called an “uncontrolled” intersection. The law for an uncontrolled intersection states that when two vehicles enter an intersection from different roadways at the same time, the vehicle on the left must yield the right of way to the vehicle on the immediate right.
Failure to yield the right of way at a stop sign or traffic signal will result in a ticket. Typically, these types of tickets are written after an accident has occurred and the officer has learned that a driver failed to yield properly. Thus, it is important to be able to claim you entered the intersection first or would have had the other driver not rolled through the stop sign. Obviously, witnesses become very helpful in these types of situations.
