Five Things to Do to Recover from a Bicycle Accident

Five Things to Do to Recover from a Bicycle Accident

Five Things to Do to Recover from a Bicycle AccidentWhen a bicycle accident occurs, it can be difficult for the injured victim to know what to do. The experienced and knowledgeable bicycle accident attorneys at Brent Gordon Law have decades of experience fighting for their clients and obtaining a fair compensation in their behalf. Our attorneys will answer all your questions during a free consultation over the phone or in person. If a negligent driver has injured you in a bicycle accident, we will aggressively fight to defend your legal rights. The following are five things to do to recover from a bicycle accident.

1. Obtain Medical Treatment

The most important thing an injured victim can do following a bicycle accident is to obtain medical treatment. Medical attention right after the accident as well as throughout the recovery process is essential. Emergency medical attention should be accessed as needed. This could be calling 911 and being transported by an ambulance, or it could be a simple visit to an urgent care facility. If symptoms are not immediately noticeable or worsen over time, the accident victim should consult with their primary care provider to make sure there will not be lasting complications from the bicycle accident. Some injuries can present themselves weeks after the accident. Such injuries should be addressed and treated as needed.

2. Report the Accident

Even if the accident seems minor, call the police to the scene of the accident so a police report is created. This is important to your bicycle accident case. The officer will most likely take statements from everyone involved as well as any witnesses. Give the police a statement of your version of what happened. Be sure to ask the officer how you can obtain a copy of the police report once it is completed.

3. Document

Take photos, video and audio recordings of the accident to be used as documentation. These can often be used as tangible evidence for a personal injury claim. Carefully document the accident itself, and any symptoms or property damages incurred from the accident. Over time bruises, scars, and cuts change. It is also helpful to your case to photograph injures over time.

If you have had to miss time from work as a result of the accident, document how much time you’ve missed and any lost wages. A personal injury attorney can help you determine compensation for such losses.

4. Contact an Experienced Bicycle Accident Attorney Immediately

Once you are able, contact an experienced bicycle accident attorney from Brent Gordon Law Firm. By contacting a personal injury attorney right after an accident, the injured victim can ensure that their right to compensation is secured. This will relieve the stress of paying for medical treatment and allow the injured victim to focus on their recovery. Insurance companies often contact victims after an accident to obtain a recorded statement. Avoid giving one until talking to an attorney. The insurance company will often use the recorded statement against you. An experienced bicycle accident attorney will talk to the insurance company in your behalf and make sure your rights are not compromised.

5. Avoid Discussing the Accident on Social Media

Though it may seem tempting to announce your accident on social media, don’t. Doing so could possibly compromise your personal injury claim. Any pictures or statements you post on social media can be used by the insurance company to decrease the value of your claim. It is best to refrain from posting any information about the accident or your recovery until your claim has been settled or resolved at trial.

7 Secrets Insurance Companies Don’t Want You to Know

7 Secrets Insurance Companies Don’t Want You to Know

7 Secrets Insurance Companies Don't Want You to Know1. Recorded statements can hurt your claim.

Insurance companies will make a huge effort to get a recorded statement so they won’t have to pay as much. The questions they ask are written to be used against you later. Check with your attorney before giving a recorded statement.

2. Insurance companies don’t want you to hire a lawyer.

Insurance companies hope you will rely on them to tell you what your case is worth. They know that a lawyer will demand more compensation for your case. One study found that attorneys recovered on average five times more money than people who were unrepresented. When you have an experienced lawyer on your side, insurance companies take your case much more seriously.

3. Tell your doctor about every injury at the first visit.

Often if you report an injury after you’ve already seen the doctor, the insurance company will claim you are lying or that were injured after the accident. It is always a good idea to report even seemingly minor problems at your first doctor visit.

4. Be honest from the beginning.

In cases where the insurance won’t settle, the jury may award you with a lot less than you deserve if they think you are being dishonest. Insurance companies won’t settle if they believe your injuries are being exaggerated. Being honest is always the best policy and will get you the best results.

5. Insurance companies want the public to think lawsuits are pointless.

Insurance companies are for-profit corporations. They want to pay out as little as possible so they can maximize profits. They prefer to deal with someone who doesn’t know their rights or what their case is worth. Brent Gordon Law Firm will hold them accountable.

6. Your insurance will make you a low offer right after your accident hoping you will take it instead of fighting for compensation you deserve.

Insurance companies prefer to settle quickly. It is a mistake to resolve a case before medical treatment is complete and your damages are fully known. Your injuries may be more serious than anticipated. You have the right to be compensated for medical bills and prescriptions, pain and suffering, time lost at work, your vehicle, etc. Brent Gordon Law will value your case and ensure you are fully compensated for all damages.

7. An insurance adjuster is a trained negotiator.

The insurance adjuster will try to test you to see what they can get away with. They may say things such as “that’s my best offer” or “if you don’t agree to accept this offer in 24 hours, it’s off the table.” Don’t be taken advantage of! Let the experienced attorneys at Brent Gordon Law Firm deal with the insurance company and get you the compensation you deserve.

Common Causes of Rear-end Collisions

Common Causes of Rear-end Collisions

Common Causes of Rear-end CollisionsAccording to the National Highway Traffic Safety Administration (NHTSA), nearly one third of all motor vehicle accidents in the United States are the result of rear-end collisions. The following are some of the most common causes of rear-end collisions.

  • Distracted driving (i.e. texting, eating, reading, etc.)
  • Speeding
  • Heavy traffic
  • Road rage
  • Fatigued driving
  • Driving under the influence of drugs or alcohol
  • Vehicle malfunction

Distracted Driving

NHTSA reported in 2017 alone, distracted driving claimed 3, 166 lives. What is distracted driving? Distracted driving is performing any activity while driving that would divert the drivers attention. For example, talking or texting on the phone, eating or drinking, talking to other people in the vehicle, changing the station on the radio, pressing buttons on a navigation screen. Anything that takes your attention away from the task of driving safely is considered distracted driving and often comes with heavy consequences.

Texting is by far the most alarming distraction to drivers. Reading or sending a text message that takes your eyes off the road for even five seconds, is very dangerous. In fact, a vehicle traveling at 55 mph travels the length of an entire football field in just five seconds. That’s like driving the length of an entire football field with your eyes closed.

Unless the task of driving has your full attention, you are not driving safely. Any activity you engage in that is not driving while behind the wheel, is a potential distraction and increases your risk of causing a car accident.

Speeding

Speeding is another huge cause of rear-end collisions. Speed limit signs are posted to protect everyone on the road. When a driver chooses to speed, they are putting everyone at risk of a car accident. In addition, injuries are often much worse at high speeds. In 2018, speeding killed 9,378 people according to data from the NHTSA. We are all busy. We all have things to hurry to get done. But speed limits are put in place to protect all road users. Faster does not mean safer.

Heavy Traffic

Many rear-end collisions are caused by a sudden change in traffic. Drivers often follow too closely for such rapid changes and thus cause a rear-end car crash. It is always important to keep a safe driving distance from the vehicle in front of you. A good rule to go by is the two-second rule. Ideally a driver should stay two-seconds behind the vehicle in front of them to avoid a rear-end collision.

Road Rage

Road rage is defined by the NHTSA as when a driver “commits moving traffic offenses so as to endanger other persons or property; an assault with a motor vehicle or other dangerous weapon by the operator or passenger of one motor vehicle on the operator or passengers of another motor vehicle”. Road rage is a criminal charge where as aggressive driving is a traffic offense.

Fatigue Driving

Fatigue driving also known as sleep-deprived driving is the act of operating a motor vehicle while being cognitively impaired by lack of sleep. Sleep deprivation is a major cause of many car accidents and can impair the human brain as much as inebriation can. Driving while sleep deprived is said to account for more than 20 percent of road fatalities.

Driving Under the Influence of Drugs or Alcohol

Any amount of drugs or alcohol in your bloodstream can impact your ability to drive safely. The effects of drugs or alcohol vary greatly, putting you and everyone else on the road at risk of an accident. Safe driving requires the ability to think clearly, make good judgement and react quickly in certain situations. Alcohol affects these skills, putting yourself and others in serious danger of a rear-end collision or other types of car accidents.

Vehicle Malfunction

Though usually uncommon, vehicle malfunction is also a major cause of many rear-end collisions. To avoid such, it is important to remember to get your car checked regularly. This is especially true before going on a long road trip or vacation that requires you to drive long distances. Vehicle malfunctions are often sudden, unexpected, and frightening. Even properly maintained vehicles can have a problem when facing different road variables. Tire blowouts, steering issues, and vehicle malfunctions cause many rear-end collisions.

Thankfully vehicle fires do not happen frequently. However, a vehicle fire can be a potentially deadly emergency. Here is what you can do to protect yourself from a vehicle fire.

The best way you can protect you and your loved ones in the vehicle is to prevent a fire from occurring in the first place. Regular car maintenance is the best way you can prevent a vehicle fire. The following are some warning signs to watch out for.

Wrongful Death Caused by Driver Failing to Yield at Stop Sign

Wrongful Death Caused by Driver Failing to Yield at Stop Sign

Wrongful Death Caused by Driver Failing to Yield at Stop SignA Shelley woman was killed in a wrongful death accident due to another driving failing to yield at a stop sign. After colliding, both vehicles came to rest in a nearby field. The first deputy on the car accident scene found the Shelley woman trapped and unconscious in her vehicle. Witnesses, as well as the deputy, began first aid until emergency personnel arrived at the scene. The woman had to be extricated from the vehicle before being taken by ambulance to a nearby medical center where she died from serious injuries. The at-fault driver was able to free himself from his vehicle and attended to the Shelley woman before emergency services arrived. Both drivers were reportedly wearing seat belts at the time of the crash. There were no signs of alcohol or drugs being involved in the accident according to the press release.

Stop Sign Accidents

The most common scenario that causes a crash at a stop sign is when a driver just doesn’t see another vehicle coming. It could be the vehicle that is required to stop doesn’t, or it stops but fails to yield the right of way. These scenarios make up 70 percent of all crashes at stop signs. Only 17 percent of car accidents involved the driver running through a stop sign.

Misjudgement

At a stop sign, drivers are required by law to not only stop but look for vehicle conflicts before proceeding. However, drivers don’t always judge correctly and thus result in a car crash. 44 percent of drivers involved in a crash at a stop sign say they just didn’t see the other car coming. Another 16 percent said their views were obstructed. These statistics are from a study conducted by the Insurance Institute for Highway Safety.

What is Wrongful Death?

Wrongful death is a legal term to describe a claim that certain individuals can make against a person who wrongfully or negligently causes the death of another. Wrongful death claims are enacted by the state legislature to govern who can bring a wrongful death claim.

A wrongful death lawsuit allows the victim’s family to seek out compensation any financial losses acquired as a result of the death. Wrongful death is also a way the family can seek justice against the negligent party.

How is a Fatality Crash a Wrongful Death Case?

The following are some scenarios in which filing a wrongful death case would be applicable.

Car Accident

Many wrongful death cases are filed after a fatal car accident. There are many ways the other driver can be found negligent for the victim’s death following a car accident. For instance, a distracted driver who caused a car crash can be held responsible for their negligent behavior through a wrongful death case if they killed the other driver. Anyone operating a motor vehicle is under oath to act responsible and drive safely. When a negligent driver chose to do otherwise and harms another, they should be held accountable.

Driving Under the Influence

A driver under the influence of drugs or alcohol is a prime candidate for being held responsible for a fatality. Clearly it is easy to see the negligence of a drunk driver.

Premises Liability

Incidents such as a slip and fall accident where the owner of the property should have known of the hazardous circumstances that caused a death make the owner liable of negligence. It is rare for a person to die from a slip and fall accident or other common premise liability scenarios. However, situations such as an accidental drowning, also fall under this category.

Rear-end Semi-Truck Accidents

Rear-end Semi-Truck Accidents

Rear-end Semi-Truck AccidentsIdaho State Police reported a rear-end semi-truck accident on Interstate 15 north of Blackfoot. A passenger vehicle was driving northbound on Interstate 15 when the driver made a lane change into the right lane and slowed. The vehicle was then rear-ended by a commercial semi-truck pulling a large trailer. The driver and passengers of the passenger vehicle were transported by ground ambulance to a nearby medical center in Idaho Falls. All drivers and passengers involved in this semi-truck accident were wearing seatbelts at the time of the crash.

Rear-end Semi-Truck Accident Damages

Being rear-ended by a large vehicle such as a semi-truck can cause devastating damages. Even a semi-truck which is not loaded is heavier and larger than most other vehicles on the road and thus causes more damages. Cargo, of course, only adds to the semi-trucks weight and increases the severity of the damage. Semi-trucks can be 40 or more times heavier than a passenger vehicle. Fully loaded, a semi-truck or 18-wheeler might weigh 80,000 pounds or more. Because of this weight, heavy trucks start more slowly, are less maneuverable, and take longer to stop or change course than a passenger vehicle. This is why large trucks and commercial vehicles are subject to higher minimum insurance requirements for their liability coverage. Semi-truck accidents often result in severe injuries and high damages and as a result, often end with high dollar settlements. If you or a loved one has been injured in a semi-truck accident, contact the experienced law office of Brent Gordon Law Firm to handle your case. Call our Idaho Falls or Pocatello law office now for a free consultation at (208) 23-CRASH.

 Override vs. Underride Semi-truck Accidents

There are two different types of risks unique to semi-trucks colliding with a passenger vehicle. These are called override or underride events.

Override

An override accident is when the semi-truck is traveling behind a small or low-to-the-ground car. The bumper of the semi-truck is likely to crush the top of the car. If this occurs, anyone in the car can suffer serious or even fatal injuries.

Underride

If a passenger vehicle rear-ends a semi-truck, the car can hit the back bumper of the semi-truck and drive under the back of the trailer. This can result in the car being crushed, trapped, or dragged by the semi-truck. Often injuries are fatal if the trailer goes through the front windshield of the car.
