Filing Wrongful Death Against Deceased Negligent Driver

Filing Wrongful Death Against Deceased Negligent Driver

Filing Wrongful Death Against Deceased Negligent DriverIt is an unfortunate fact that some car accidents result in death. When a victim dies in an accident due to the negligence of another driver, his or her estate (usually represented by surviving family members) can pursue a wrongful death claim on the decedent’s behalf. If you are looking to file a wrongful death claim against a deceased person, you will be dealing with his or her estate. The person named as the deceased “executor” or “personal representative” will be asked to represent the deceased at-fault party. The negligent party’s estate is comprised of the property he or she left behind after death.

In most wrongful death cases when the negligent driver is deceased, their estate will need to pass through a probate process in court before you will be able to proceed with your case. During this process, an estate is divided to pay debts and deliver inheritances to the person’s beneficiaries fairly. By pursuing a wrongful death claim, you will become a potential creditor, and the estate will need to pay you a settlement.

Wrongful Death Claims

Since wrongful death claims are governed by a statute enacted by the legislature, the persons who are entitled to recover claims are set by statute. In addition, the types of damages a person may recover are set also by statute.

Receiving Compensation for Wrongful Death

When a person is wrongfully or negligently killed because of another, family members of the deceased have a right to compensation. The wrongful death attorneys at Brent Gordon Law Firm have helped clients recover substantial monetary settlements from the negligent persons who caused the wrongful death. Many different factors will determine the amount of compensation you may receive for a wrongful death such as:

  • Proposed income from the deceased
  • Savings of the deceased
  • Number of dependents
  • The degree of negligence that caused the wrongful death

5 Common Mistakes That Can Hurt Your Worker’s Compensation Case

5 Common Mistakes That Can Hurt Your Worker’s Compensation Case

5 Common Mistakes That Can Hurt Your Worker’s Compensation CaseWorker’s compensation attorneys of Brent Gordon Law Firm in Southeast Idaho serve clients in PocatelloBlackfootIdaho FallsRigby, Rexburg, and other surrounding areas. Our worker’s comp lawyers have the knowledge and experience to help you obtain a fair settlement for the injuries you sustained while at work. Personal injury attorney Brent Gordon, as well as other attorneys at Brent Gordon Law Firm, will help you deal with insurance companies, medical bills, and lost wages resulting from an accident at work. Our experienced and aggressive attorneys will fight to get you every penny you are owed. Let our aggressive lawyers in Idaho Falls and Pocatello take the stress out of your worker’s compensation case. The following are five common mistakes that can hurt your worker’s compensation case.

Mistake 1: Failing to Report Your Accident Properly

The most import thing you can do to help your worker’s comp case is to report your accident to your employer. Most jobs which involve the risk of accident, have an employee manual which tells the accident policy. If this is the case, follow the guidelines in the manual to properly report your injury or accident. If there is no accident policy, let your supervisors, co-worker’s and any human resource people known of your injuries.

Sometimes a worker’s compensation claim is denied because the employer was not notified of the accident in a timely manner. Some employees tell the injured worker that they had to report the accident within 24 hours. Though this is not the law. In addition, some employers will tell a recent hire that they are not yet eligible for work comp benefits. This is also not the law. Typically, the law only requires that written notice be given within 30 days of the accident. However, there are exceptions to this rule. We recommend contacting an experienced worker’s compensation lawyer from Brent Gordon Law Firm to handle complications such as this.

Mistake 2: Failing to Give an Accurate Medical History

After being injured on the job, you will want to visit a medical professional to obtain medical records of the injuries. This will greatly help your case. However, while visiting with the doctor or medical professional, be sure to give an accurate and up to date medical history. If you fail to tell the medical provider how your injury occurred or that it occurred while at work, you could be harming your claim. This could also prevent you from receiving the medical care you need. Tell the medical provider of all your symptoms or complaints so they can properly diagnosis the situation.

Mistake 3: Failing to Follow Up on Requested Medical Treatment

When a medical professional suggests medical treatment or follow up procedures, they do so for your benefit. Failing to follow up with treatment could harm your worker’s compensation claim. Be thorough with the doctors you are working with and follow all instructions given to be sure to have the best outcome. When an injured employee continues to miss appointments, the insurance company or your employer have the option to suspend your work comp benefits.

Mistake 4: Not Knowing When to Return to Work

At the request of the worker’s compensation insurance, most employers will provide light duty to the injured worker. Either the employer or the insurance adjuster may request that the injured worker return to work. Unfortunately, this could cause a hostile environment that could cause problems for your claim, your settlement offer, and your employment. Since the employer now has to find tasks that the injured worker is capable of, other employees may be asked to assist which could create an uncomfortable environment for everyone. It is important to remember to perform only tasks within your work restrictions as to not harm your recovery process. If an employer asks you to perform a duty outside of your restrictions, show them your doctor’s note that contains your work restrictions. If your doctor does not approve the job description or your employer asks you to work outside your restrictions, you do not have to return to work.

Mistake 5: Not Hiring an Experienced Worker’s Compensation Lawyer

After being injured on the job, many people fail to seek the advice of a worker’s compensation lawyer for the following reasons.

  • They don’t believe they need a lawyer.
  • They don’t know of a lawyer to contact, so they don’t bother to find one.
  • They aren’t sure if they can trust a lawyer, so they won’t use one.
  • The insurance company told them they would end up with less money if they hired a lawyer. (This is definitely NOT true.)
  • They fear their employer will retaliate against them or treat them poorly.

All of these reasons are really reasons to hire a lawyer. In spite of all these fears, an experienced worker’s compensation lawyer from Brent Gordon Law Firm will fight for every penny you deserve. Our law firm believes every client deserves fair representation against big insurance companies with deep pockets. Top 5 Ways to Maximize Your Semi-Truck Accident Settlement in Idaho

Top 5 Ways to Maximize Your Semi-Truck Accident Settlement in Idaho

Top 5 Ways to Maximize Your Semi-Truck Accident Settlement in IdahoSemi-truck accidents often lead to complex issues when dealing with the insurance company. Though you may be tempted to try to settle the case yourself, hiring an experienced semi-truck accident lawyer from Brent Gordon Law Firm will get you more money, faster. A commercial truck company is sure to be represented by a big insurance company with deep pockets. Brent Gordon Law Firm believes every client deserves fair representation against big insurance companies with deep pockets. Our experienced truck lawyers will fight for every penny you deserve. It is important for you to understand the steps you as the client need to take to help us maximize your trucking accident settlement. The following are the top five ways to maximize your semi-truck accident settlement in Idaho.

1. Immediately Seek Medical Attention

Semi-truck accident often leads to serious or even deadly injuries. It is important to first seek medical attention following a serious semi-truck accident. Seeking treatment will not only get you on the path to recovery, but the medical professional who treats you will create medical records that can later be used to help your case.

2. Follow All Instructions from Your Medical Professionals

It is important to follow all instructions from your doctors and go to all your scheduled appointments. Failure to show at medical appointments gives the insurance company an excuse to reduce your settlement value claiming that you are not seeking medical treatment they are paying for. They may also claim that your injuries were not that severe because you didn’t even bother to follow the doctor’s treatment plan.

3. Avoid Speaking with the Insurance Company

Trucking companies are known for having resourceful insurers who known how to make you settle for less, so they pay out as little as possible. It is their goal to try and get you to settle quickly so as to only pay out the minimum amount. Though it may be tempting to resolve the case quickly, in the end it is likely you will lose out on hundreds or even thousands by choosing to settle quickly. Instead, trust the semi-truck accident attorneys at Brent Gordon Law Firm to get you a fair settlement from the insurance company. Avoid speaking with the insurance without your attorney. If they do call, only answer the bare minimum and instead direct them to your attorney.

4. Provide Proof of All Lost Income

If your injuries caused you to miss work, you will need to provide detailed documentation to your attorney in order to be fully compensated for any lost income. Often truck accidents cause serious injures which can keep a victim from returning to work for several weeks. This loss of income can be compensated for during the settlement, but proper documentation is needed. Documentation includes paperwork from your employer stating the amount of compensation that you normally would receive along with the amount of time missed.

5. Hire a Semi-Truck Accident Attorney from Brent Gordon Law Firm

As stated previously, hiring an experienced semi-truck accident lawyer is a must if you want to get the most out of your settlement. The semi truck accident lawyers at Brent Gordon Law in Idaho Falls and Pocatello are experienced in representing accident victims involved in crashes caused by semi trucks, big rigs, tractor trailers, or other commercial vehicles. Your attorney will be well versed in the rules and regulations surrounding the trucking industry, so you won’t need to worry about being taken advantage of by the trucking company’s insurance company.

Injury Crash on Yellowstone Highway from Driver Failing to Yield

Injury Crash on Yellowstone Highway from Driver Failing to Yield

Injury Crash on Yellowstone Highway from Driver Failing to YieldIdaho State Police reported an injury crash on Yellowstone Highway from a driver failing to yield. A vehicle traveling eastbound on 65th S attempted to turn left onto Yellowstone Highway to go northbound and collided with an oncoming pickup truck. Police reported both drivers were transported by private vehicles to a nearby medical center for evaluation of injuries. The southbound lanes of Yellowstone Highway were partially blocked for a little over an hour as crews worked to clear the car accident.

Consequences of Failing to Yield

A common cause of car accident is failing to yield. Many impatient drivers cause a collision with just a quick misjudgment. However, all drivers have a duty to obey all rules of the road in order to avoid causing a collision. See Idaho Rules of the Road regarding failure to yield here.

Failure to yield the right of way when required by law can lead to liability for any resulting car crash. The difference between these types of accidents and other car accidents is that often the injury victim drives into the car that fails to yield. For instance, when a driver makes a left turn but fails to yield to oncoming traffic, or when a driver is aggressive about merging onto the highway, or when a driver is entering the street from a private driveway.

Failing to Yield is Negligent Driving

When a person is hurt by another driver failing to yield, the at-fault or negligent driver can be sued for damages. Things such as medical bills, damage to the vehicle, pain and suffering and more can all be compensated for during a car accident case.

After an accident, take photos of all property damage to your vehicle and all other vehicles involved. It is also a good idea to keep records and take photos of injuries. You should also exchange contact and insurance information with all other drivers. In addition, gather contact information of any witnesses to the accident. Providing all this information and evidence to your car accident lawyer can greatly help the outcome of your case.

Head-on Motorcycle Accident Involving Three MotorcyclesIdaho State Police reported a head-on motorcycle accident involving three motorcycles. Two Injured from Car Crash in Pocatello

Two Injured from Car Crash in Pocatello

Two Injured in Car Crash from Driver Running a Red LightIdaho State Police reported two injured in a car crash from a driver running a red light in Pocatello. The crash occurred when a driver failed to stop at a red light, entering the intersection at a high rate of speed. A passenger vehicle was struck in the intersection. After impact, the vehicle continued and struck a nearby building. Both drivers involved in the car crash were reportedly injured. Only one was wearing a seatbelt at the time of the collision. Both were transported by ground ambulance to a nearby medical center for evaluation of injuries. Idaho State Police is investigating this car crash.

Why Do Drivers Run Red Lights?

56 percent of drivers admit to running red lights part of the time. That’s a large percentage. But why? Most of the time, drivers run a light when it has just barely turned red. For instance, if the driver in front took a bit longer than expected to proceed through the intersection or the driver thinks they can “beat the yellow” and misjudge the timing.

The vast majority of drivers run red lights because they are in a hurry or they are feeling impatient. However, is the risk of a car accident worth arriving two or three minutes later? No. Of course not. Running a red light creates tremendous danger for the driver, passengers, and any other drivers on the road. Even when the driver has an arguably good reason to run a red light, such as an emergency situation, it’s important to avoid the temptation.

Consequences of Running a Red Light

A driver has a split-second to decide if they are going to proceed after the light turns yellow. That leaves little time for the driver to consider the possible life-altering consequences of running a red light. The following are a few consequences of running a red light.

Car Accident Fatalities from Running a Red Light

About 60 people were killed each month in a car accident during 2015 as a result of a driver deciding to run a red light. That amounts to over 800 fatalities per year or about two fatal car accidents each day in America from a driver running a red light.

Significant Injuries from Running a Red Light

An accident from someone running a red light typically involves the vehicle moving at a high rate of speed. Red light running accidents usually result in a “t-bone” collision that often results in serious injuries or even death. Due to the lack of protection on the sides of a vehicle, an angular collision such as a “t-bone” accident often leads to serious injuries.

Aggressive Driving

Running a red light is known as aggressive driving. Aggressive driving reflects a driver’s lack of care or safety to other drivers. These types of actions often lead to severe sanctions or even criminal penalties if an accident occurs.

How to Avoid Red Light Accidents

There is no guarantee of avoiding a collision with someone running a red light. However, there are a few things you can do to decrease the odds.

Pause Before Proceeding

Before proceeding through the intersection, count to three. Pausing to wait before you move through the intersection after the light turns green could save you from a collision.

Look Before Proceeding

Before proceeding through the intersection after the light has turned green, look both ways as if you would before crossing the street.

Pay Attention to Those Around You

Many drivers become distracted with their cell phone while waiting at a stop light. Avoid temptation. Instead, pay attention to the flow of traffic. Are other drivers around you acting erratically? Is traffic heavy? What might the person next to you be thinking of doing after the light turns green? Will they cut you off to get ahead of some traffic? All of these questions are things to consider to help you avoid a collision.
